STAT+ is the premium content area found on www.statnews.com and includes coverage in biotech, pharmaceuticals, business, and government policy (“STAT+”). In addition to the STAT General Terms of Service found here: https://www.statnews.com/terms-conditions, the following subscription terms shall also apply to any STAT+ individual, group, or licensing subscription (“Subscription Terms”).

  1. DEFINITIONS.

1.1       Authorized User: For individual subscriptions, an authorized user is the one individual for whom a subscription has been purchased. For group subscriptions, an authorized user is an identified group member, or in the case of an enterprise-wide subscription, a current employee, or current student in the case of academic institutions, of the licensing company, organization, institution or association.

1.2       Digital Product: The term “digital product” refers to paid digital products available from STAT, including both STAT digital subscriptions and one-time purchases.

1.3       Group Subscription: A per-seat purchase, which serves a means of executing subscriptions for a group of individuals (more than 1) who all are part of the same organization. This allows for individuals within the group to access the STAT+ content, but not distribute or share said content to non-subscribers.

1.4       Group Administrator: A “group administrator” is an Authorized User or delegate of Licensing Organization who has completed the group subscription registration process and has confirmed his or her identity (via email). Responsibility of Group Administrators are set forth in Section 3.2 below.

1.5       Valid Email Address: A valid email address for an Authorized User is one that uses the same URL(s) as provided by the subscribing group (e.g. [email protected]). Valid email addresses must match back to individual people at an organization. Emails that are meant for group access, or infer group access (i.e. [email protected], [email protected], [email protected], etc.) are not permitted and accounts using such email addresses may be deleted in STAT’s sole discretion. Access via an email address is limited to that individual, and cannot be shared with other individuals inside or outside of the licensing organization. For individual subscriptions, a valid email address is assigned to one individual (i.e. does not imply shared access, like [email protected]).

1.6       Promotions & Trials: a limited-time offer, rate or term of access, the terms of which are determined by STAT, that allows individuals to access STAT+.

 

  1. STAT+ SUBSCRIPTION BENEFITS – BOTH GROUP AND INDIVIDUAL

2.1       General Benefits. After purchasing a STAT+ subscription (whether individual or group) you must provide a Valid Email Address to STAT. Once verified, the following benefits apply to individual and group subscribers:

  • Access to all STAT+ content on statnews.com, including the STAT+ archive
  • Subscriber-only email newsletters
  • Access to breaking STAT+ news alerts
  • Access to the STAT+ live-chat channel for group discussions with subscribers, reporters, and industry experts (See Section 2.2).
  • Early access to reports on industry trends
  • Early-bird invitations and discounted rates to select industry events, pre-determined by STAT and media partners
  • Invitations to Subscriber-only STAT events
  • Ability to print STAT+ content for individual personal use by an Authorized User

2.2       STAT+ Live-Chat Channel.

2.2.1    Closed Discussion. The STAT+ Live-Chat channel is a closed on-line discussion area located on www.statnews.com for online discussions between STAT editors and reporters and authorized STAT+ subscribers, only. All discussions are considered “off the record.” If STAT wishes to use any comments (anonymous or attributed) from the discussion, STAT will reach out directly to the individual for permission.

2.2.2    No Re-Use. No STAT+ live-chat participant is permitted to use, repurpose, or quote any content from any individual in any STAT+ live-chat discussion. Any breach of this term may result in immediate termination of the subscription to STAT+ and the STAT+ live-chat Channel. If a user is part of group subscription, any breach in this term may also result in immediate termination of the group subscription for the entire group, as well.

2.2.3    STAT Disclaimer. Any comment by an individual Authorized User represents the thoughts or ideas of that individual and not of STAT. STAT cannot be responsible for, and disclaims all liability related to, the accuracy of any comments made during a STAT+ discussion.

2.2.4    Incorrect Information. Any information presented by an Authorized User that is found to be factually incorrect and presented as a means to spread that incorrect information, will result in a warning from STAT to the user. A second infraction of presenting false information may result in that user (and potentially the group, if the user is a part of a group subscription) being terminated from the STAT+ live-chat Channel. Notwithstanding foregoing, STAT shall be under no obligation to monitor the Live-Chat channel for factually incorrect information.

2.3       STAT+ Event Benefits. Throughout the year STAT may host events that are owned or managed by STAT, or events that STAT has partnered with a third party to produce to offer STAT+ subscribers additional benefits. STAT+ subscribers will have early access to tickets and price discounts (if applicable) to those events. Such STAT+ Event Benefits vary on a per event basis. Certain additional restrictions and terms may apply to each event benefit.

 

  1. STAT+ GROUP SUBSCRIPTIONS

3.1       STAT+ Group Subscription Agreement. All STAT+ Group subscriptions are subject to the terms of the relevant Group Subscription Agreement. In the event of a conflict between these Terms and the Group Subscription Agreement, the Group Subscription Agreement governs.

3.2     Changes to Subscription. STAT reserves the right to change Group Subscription and licensing pricing, effective at the point of renewal. If you add users to your Group Subscription prior to the end of your contract, you will be billed at a pro-rated rate for those new users for the remainder of the contract year.

3.3       One Registered User. Organizations with Group Subscriptions shall appoint one Registered User with STAT. The Registered User will be responsible for communicating all STAT+ benefits, means of registration, and terms & conditions, to Authorized Users and constituents who are eligible to register and become Authorized Users.

3.4       Individual Contact. Access will be granted to the individuals who provide a Valid Email Address from the licensing company. The number of individuals in a group is determined by the agreed upon contract. If more users attempt to become Authorized Users than are permitted for in the contract, the contract will need to be amended and payment collected prior to the additional users receiving access to STAT+.

3.5       Limitation of Access. Access to STAT+ through a Group Subscription is limited to those directly and currently employed by the subscribing organization and authorized by the subscriber organization. Access to STAT+ and/or STAT+ content cannot be shared with individuals or organizations who are partners, members, vendors, clients or other individuals (collectively, “Affiliates”) who are not employees of the subscribing organization, unless those individuals are also STAT+ subscribers or the subscribing organization separately purchases licenses for those Affiliates.

3.6       Academic Organizations. For academic institution group subscribers, access is granted for any individual who is a current, registered student, faculty member, staff member, or affiliated researcher, with a valid email address from the licensing institution. Certain methods of IP authentication for users are available, as well.

3.7       Trade Organizations. For a trade organization or member association, access to STAT+ is limited to those individuals who work directly for the subscribing organization or association, with a valid email address from that licensing organization or association. A trade organization or member association subscription does not include access for members of the association or organization unless this is outlined in the Group Subscription Agreement.

3.8       Multiple Group Subscriptions. If there are multiple Group Subscriptions within a subscribing organization (i.e. multiple departments registered, or multiple international offices registered), it’s the organization’s responsibility to coordinate consolidation under one group subscription if it so desires. STAT is not responsible for consolidating multiple groups that may occur within a single licensing organization.

3.9        Redistribution Rights.

  1. Distribution Prohibited. No Authorized User is authorized to email transmit, copy, or distribute STAT+ Content, or any portion thereof, to non-Authorized Users in any manner or for any purpose without STAT’s prior express written permission, unless the Authorized User has obtained redistribution rights by purchasing a license.
  2. Reproduction, Alteration, Translation, and Adaptation Prohibited. No Authorized User may: (1) create a copy or download of a STAT+ article or portion thereof; (2) distribute or forward a copy (electronic or otherwise) of any STAT+ article, material or document obtained on a the Digital Products with any non-Authorized User in any manner without STAT’s prior express written permission, unless they have obtained redistribution rights as a part of a redistribution license; (3) reproduce or photocopy any STAT+ article, material, or document; (4) alter, modify, adapt, or translate any STAT+ article or material from a Digital Product to a non-Authorized User; (5) include any article, file, or material in any derivative work or create derivative work from a Digital Product, including without limitation, articles, material or documents; (6) re-sell or charge for STAT+ content; (7) store STAT+ articles on an internal or external web pages accessible to other users.
  3. No Additional License Granted. Unless Licensing Organization elects to purchase a license, entering into a Group Subscription Agreement shall not be construed to grant any additional license to Licensing Organization or its Authorized Users to share STAT+ content with any individual who is not an Authorized User or any organization which is not itself a licensing organization.

 

  1. PRICING, BILLING AND FREE TRIALS

4.1       Price. When you purchase a Digital Product, the price will be made clear during the order process. You agree to pay the price that is stated at the time of your order, as well as any applicable taxes. You also agree to the billing frequency stated at the time of your order. You will be billed in USD. Receipts will be available in other currency, as needed. Contact our Customer Care team at [email protected] if you need an updated receipt or proof of purchase. Receipts are also available for download in the Billing History section of your account.

4.2       Pricing Errors and Discounts. If a stated price is determined by us in our sole discretion to be in error, we are not under any obligation to offer you the product at that price. We will notify you of the error and give you the opportunity to cancel your order and obtain a refund if payment has already been made. Discount eligibility is determined at the time of the order. Discounts cannot be applied retroactively.

4.3       Additional Product Prices. STAT reserves the right to add to the Digital Product offerings. Your current subscription may not include access to all areas of the Digital Product, and you may have to pay additional fees for full access of these added products. These additional charges will be clearly stated.

4.4       Third Party Fees. When you use your Digital Product, you may incur other additional charges from third party service providers, such as telecommunications fees, data fees or service provider fees. You are responsible for paying any additional charges.

4.5       Free Trials.

4.5.1    30 Day Trial. The 30 day free trial does not apply for accounts created after Aug 31st, 2023 or that are re-subscribing after cancelling. Those accounts will be charged immediately for the plan identified at the time of re-order. We will charge or debit your payment method at the end of your free trial period for the plan identified at the time of your order. We reserve the right to stop offering free trials, without notice, at any time. YOU MAY CANCEL YOUR FREE TRIAL ANY TIME PRIOR TO BEING CHARGED.

4.5.2    Additional Promotions or Offers. We may occasionally offer Promotions and Trial offers. The specific terms of each promotion are stated at the time the promotion is offered. Each promotion may be different. Promotions and Trial Offers cannot be combined. We will not notify you in advance that the promotion is about to end and we will not notify you when your promotional rate has ended. To cancel and avoid being charged, you must notify us before the promotion ends.

4.5.3    Payment Details. You are required to provide your payment details when you sign up for a promotion. At the end of the promotion, your subscription will automatically renew at our monthly subscription rate (except for Group Subscriptions and licenses, which do not auto-renew).

4.6       Automatic Renewal. Except for certain Group Subscriptions and licenses to redistribute, all STAT+ subscriptions are renewed automatically. Group Subscriptions are renewed automatically except for (i) those governed by a Group Subscription Agreement that specifically says that the subscription will not renew automatically, and (ii) those that began before September 1, 2020 and have not been renewed after September 1, 2020. At the end of each subscription term, your subscription will be automatically extended for successive renewal periods of the same duration at a price that will be disclosed to you in advance (excluding any applicable taxes), unless you cancel your subscription prior to the end of its term or unless we notify you otherwise in advance. By purchasing a subscription, you authorize STAT to charge your payment method(s) now and again at the beginning of each subsequent renewal period. Unless you notify us before a charge that you want to cancel or do not want to auto renew, you understand your subscription will automatically renew and you authorize us (without notice to you, unless required by applicable law) to collect the then-applicable subscription price and any taxes, using any credit card we have on record for you.

4.7       Billing Cycle and Payment Method View. To view information about your billing cycle and payment method, visit the My Account area of statnews.com

4.8       Unpaid Charges. If your credit card expires or your payment method is otherwise invalid, your subscription may not automatically be terminated. You will remain responsible for all charges. You will be responsible for all costs we incur in connection with the collection of unpaid amounts, including court costs, attorneys’ fees, collection agency fees and any other associated costs.

4.9       Initial Payment Refusal. If your initial payment authorization is later revoked, your subscription, product or access will be terminated. You may contact our customer care team at [email protected] if you believe your access was terminated in error.

4.10     Additional Offerings. STAT reserves the right to add to the digital product offerings. Your current subscription may not include access to all areas of the digital product, and you may have to pay additional fees for full access of these added products. These additional charges will be clearly stated

 

  1. STAT+ CANCELLATION AND REFUND POLICY

5.1       Cancellation by You. You may cancel your STAT+ subscription at any time by going to www.statnews.com/my-account, clicking on the Cancel Account link, and following the instructions. When you cancel an annual or monthly subscription, you cancel future charges associated with your subscription. You may notify us of your intent to cancel at any time. Cancellations are effective at the end of your then current subscription term and you will continue to have access to STAT+ until the end of that term. In the event that you decide to cancel your annual subscription within the first 30 days of your subscription or within 30 days after any subsequent renewal, you will receive a full refund of any fees paid for that term, but will immediately lose access to STAT+.

We recommend printing out transaction data (e.g., your receipt) and the Terms of Use and keeping them in an easily accessible place.

5.2       Cancellation by Us. We reserve the right to suspend or terminate your subscription or product for any reason, with or without notice and without further obligation. You will not be entitled to a refund of any fees.

5.3       Cancellation During Promotions and Trials. Certain promotions may not permit cancellation and/or refunds during the promotional period. You agree to the cancellation and refund terms stated at the time of purchase.

 

  1. STAT+ REGISTRATION AND SECURITY

6.1       Credentials. As part of the registration or account creation process for STAT+, you will create login credentials by selecting a password and providing a Valid Email address. You must provide us with certain registration information, all of which must be accurate and updated. (a) You may not (i) select or use the login credentials of another person with the intent to impersonate that person; (ii) create a shared account for use by more than one person (only the person whose personal information is associated with the account is authorized to access STAT+; we reserve the right to monitor account usage to identify accounts being used by more than one person and to suspend any such accounts that we identify); or (iii) use login credentials that we, in our sole discretion, deem offensive. Failure to comply with the foregoing shall constitute a breach of these Terms of Service, which may result in immediate termination of your account. (b) You shall be responsible for maintaining the confidentiality of your password, which you will not be required to reveal to any representative or agent of STAT unless such revelation is ordered by any court, or is otherwise legally required.

6.2       Unauthorized Use. You shall notify [email protected] of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password or credit card information. You are responsible for all usage or activity on your STAT account, including use of the account by any third party authorized by you to use your login credentials. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your account, at our sole discretion, and we may refer you to appropriate law enforcement agencies.

6.3       Must be Over 13. You must be 13 years or older to use or subscribe to all parts of the Services.

 

  1. CHANGES TO SERVICES AND UNAVAILABLE SERVICES

7.1       Changes to Services and Content. We reserve the right to make changes to our Services at any time. If we temporarily reduce or eliminate the charge for content or access that you are currently paying for under different terms, you will not receive a refund.

7.2       Unavailable Services. If any or all of Services are temporarily unavailable, you will not automatically receive a refund. We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.
